In Consumer Complaint No. 19 of 2018, filed by Kamlesh Patni against the Post Office, Almora and others, the District Consumer Disputes Redressal Commission, Almora has dismissed the case due to the complainant’s continued absence and failure to pursue the matter.
During the hearing held on 21st July 2025, the complainant was not present before the Commission. On the other hand, Advocate Mr. Pankaj Latwal appeared on behalf of Opposite Parties No. 1, 3, and 4, while a representative was present for Opposite Party No. 5.
The Commission noted that the complainant had failed to comply with the directions of the Hon’ble State Consumer Commission, Dehradun. Consequently, a registered notice was issued on 27th May 2025, directing the complainant to appear in person and ensure representation before the Commission. As per the tracking report (44k), the complainant received the said notice on 28th May 2025.
Despite receiving the notice, neither the complainant nor any counsel appeared before the Commission. Interestingly, the complainant’s advocate was present in other matters before the Commission on the same day, but stated that he had received no instructions from the complainant to appear in this particular case.
The Commission observed that the complainant no longer appears interested in pursuing the matter. Hence, in the interest of justice, the complaint is dismissed due to lack of prosecution and non-compliance with the directions of the Hon’ble State Consumer Commission.
Order:
“In view of the continuous non-appearance of the complainant, the above complaint is dismissed for default and stands disposed of accordingly. Let the case file be consigned to record.”
